TERMS AND CONDITIONS

 1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia who are aged 18 years or over.
3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete or indecipherable entries will be deemed invalid.  Entry is not available with respect to any products other than those eligible Selleys products specifically outlined in the entry mechanics.
6. Multiple entries permitted, subject to the following: (a) only one entry allocated for every $10 spent on eligible Selleys products in the same transaction; and (b) each transaction must be submitted separately and in accordance with entry requirements.
7. Entrants must retain their original purchase receipt(s)/invoice(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s)/invoice(s) must clearly specify the store of purchase, the products purchased and that the purchase was made during the promotional period but prior to entry.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
9. Premium SMS cost is 55c. Entrants must have premium service access. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded.  Entries are deemed to be received at the time of receipt into the promotion database  and NOT at the time of transmission by the entrant. SMS entries via the internet are not valid and will not be accepted.
10. Promotion commences July 1st 2008. Entries close 5pm AEST on 31st August 2008. The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne, VIC, 3004 on Wednesday 3rd September 2008 at 10am.
11. Winners will be notified by mail and telephone or SMS and their names will be published in The Australian on Wednesday 10th September 2008 and at www.selleystrade.com.au.
12. The Promoter’s decision is final and no correspondence will be entered into.
13. The first three (3) valid entries drawn will each receive an LG 42” HD Plasma Flat Screen TV valued at $1,899 each.
14. [The next three (3) valid entries drawn will each receive a Microsoft Xbox 360 console valued at $539.
15. [The next twenty (20) valid entries received will each win a construction radio valued at $145 each.
16. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
17. Unless expressly stated within these Conditions of Entry regarding all prizes, all other expenses become the responsibility of the winners.
18. [If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.
19. Total prize pool value is $10,214
20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
21. A draw for any unclaimed prizes may take place on Wednesday 3rd December at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on Wednesday 10th December.
22. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
25. All entries are deemed to be received at the time of receipt into the Promotional database and NOT at the time of transmission by the entrant.
26. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
27. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Winners are solely responsible to pay any and all taxes and the Promoter recommends that winners seek independent financial advice.
28. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
29. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing and publicity purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
